Employers ban vaping as its reputation goes up in smoke
Vaping and e-cigarettes are being used to cut out, cut back or completely quit traditional tobacco. With vaping becoming more common in the workplace, employers are realizing that the same policies in effect for traditional cigarettes are not in effect for e-cigarettes. Reports on the health concerns associated with vaping and e-cigarettes are mixed. While some say the products are less harmful than traditional cigarettes, others link them to serious health consequences such as lung disease, noted Julie Stich, vice president of content at the International Foundation of Employee Benefit Plans (IFEBP).
Given the popularity and risk associated with vaping, it's made an impact on employers. "Vaping and the use of e-cigarettes pose many of the same risks of cigarette smoking to employees and the workplace," Haynes and Boone Partner Jason Habinsky said in an email to HR Dive. What's more, workers who choose to use e-cigarette products can put those who share their space at risk as well.
A lack of vaping policies
Vaping has been around for a little while now, said attorney Marissa Mastroianni, an associate at Cole Schotz, but a lot of employers still haven't created policies.
Stich concurred, noting that only 46% of U.S. employers in a recent IFEBP wellness survey reported having a vaping policy, with a "large chunk" of respondents say they weren't sure if they did.
But this may soon change. A recent increase in vaping-related illnesses, combined with a warning from the Centers for Disease Control and Prevention has driven some employers to take a second look at their policies, said Kerry Sylvester, director of product management, wellbeing solutions at HealthAdvocate. In the absence of specific vaping-related laws, company culture and priorities are driving policy. "Many larger employers including Target and Wal-Mart are leading the way by including vaping in their workplace tobacco policies, and many smaller employers are following their example," she said.
Mastroianni concurred: "There is a trend that employers have been adding vaping to their no-smoking policies," she said. This is a good thing, according to Habinsky. "[I]t is important that employers review all policies which regulate smoking or other health and safety considerations and modify the scope of such policies to include vaping and e-cigarettes," he said.
For employers that lack policies putting boundaries on vaping, the first step is to consider any applicable local laws, Mastroianni said. New York and New Jersey, for example, have adopted vaping laws relating to smoke-free workplaces and smoking in public areas. "If a law like that exists in your jurisdiction, you need to comply," said Mastroianni.
Stich noted that laws in some areas may treat vaping differently than smoking, and employers need to be aware of this (she cited a list of current vaping laws here). Additionally, employers will need to note that vaping and e-cigarette use "may also be prohibited in certain industries and work environments where health and safety may be at risk," said Habinsky.
Competing priorities
When no specific law applies, however, employers have more flexibility. This is the point at which priorities begin to compete.
"Vaping has been viewed as a substitute for traditional tobacco use both for recreational users as well as by individuals who are trying to cut back or quit smoking," said Sylvester, speaking to HR Dive via email. "Employers want to support employees who are trying to make positive changes in their health by quitting smoking, but must consider the needs of their entire workforce."
Employees who want to sit at their desks and vape may say they're not bothering co-workers, but this is not necessarily true, said Stich. "There can be a residual odor and co-workers can find this annoying."
Annoyance is not the only thing e-cigarette users may inflict on coworkers. "Vaping can pose challenges for individuals with scent sensitivities, not to mention the concerns related to secondhand exposure to vaping aerosol," said Sylvester. And, unlike traditional cigarettes, "[a]n e-cigarette can also malfunction or even explode, causing harm to individuals in the workplace," said Habinsky.
Productivity concerns also factor in. "[E]mployers must also consider the positive or negative impacts on productivity by allowing employees to take vaping breaks away from their workspace versus vaping at their desks," said Sylvester.
Once employers have updated or created vaping policies, it's up to them to make sure employees know about the changes. "Employers should also update any related employee training to include a discussion of such prohibitions," said Habinsky. "Employers should also examine any wellness policies and employee education to ensure the inclusion of such use."
A call employers need to make
"While supporting employees who want to quit tobacco is a priority, employers must decide if allowing the use of nicotine products that are not [Food and Drug Administration-]approved is beneficial in the short and long term," said Sylvester. It's worth noting that "the jury is still out" as to whether vaping and e-cigarettes actually do help people stop smoking regular cigarettes, Stich said.
"It's kind of tough at the moment," said Mastroianni, and it's an area with a lot of nuance. "On the one hand, you want clear air for employees to work and to protect against inhaling secondhand smoke. On the other hand, a lot of people do use vaping and e-cigarettes as a way to stop smoking actual cigarettes."
Ultimately, said Mastroianni, "employers need to make a judgment call and decide, 'what's better for us?'"

DOL updates FLSA regular rate rule
With the New Year right around the corner, it's important to know what rules are being updated. The U.S. Department of Labor has updated the "regular rate of pay" to calculate overtime pay. This standard is used to calculate overtime pay under the Fair Labor Standards Act (FLSA). Read this blog post for more information on this final rule.
The U.S. Department of Labor (DOL) has issued a final rule updating the "regular rate of pay" standard used to calculate overtime pay under the Fair Labor Standards Act (FLSA), according to a notice to be published in the Federal Register Dec. 13.
In the rule, DOL clarifies when certain employer benefits may be excluded when calculating overtime pay for a non-exempt employee, including bona fide meal periods, reimbursements, certain benefit plan contributions, state and local scheduling law payments and more. The rule also clarifies how employers may determine whether a bonus is discretionary or nondiscretionary.
The rule will take effect Jan. 12, 2020.
The rule will likely result in employers taking a closer look at their benefits packages, Susan Harthill, partner at Morgan Lewis, told HR Dive in an emailed statement.
A number of employer advocates that submitted comments on DOL’s Notice of Proposed Rulemaking (NPRM), including the Society for Human Resource Management, supported excluding employee benefits like gym memberships, tuition assistance and adoption and surrogacy services from regular rate calculations. Gym memberships and tuition assistance are generally excludable, according to DOL, but the agency said only some forms of adoption assistance would be excludable and that most surrogacy assistance payments would not be.
Employers also inquired about public transportation and childcare subsidies. In the final rule, DOL said public transportation benefits would not be excludable, noting that the agency "has long acknowledged that employer-provided parking spaces are excludable from the regular rate but commuter subsidies are not." But it did add clarifying language around childcare, saying that while "routinely-provided childcare" must be included in the regular rate, emergency childcare services — if those services are not provided as compensation for hours of employment and are not tied to the quantity or quality of work performed — may be excluded.
DOL also offered additional details about its treatment of tuition reimbursement and education-related benefits. As it stated in the NPRM, the agency said that as long as tuition programs are offered to employees regardless of hours worked or services rendered are "contingent merely on one’s being an employee," such programs qualify as "other similar payments" excludable from the regular rate. This includes payment for an employee's current coursework, online coursework, payment for an employee’s family member’s tuition and certain student-loan repayment plans, DOL said.
HR teams should respond by performing audits of the pay codes for benefits that would be impacted, Tammy McCutchen, shareholder at Littler Mendelson, told HR Dive in an interview: "This is a good time to get your calculations correct." McCutchen suggested that employers conduct audits first before deciding whether to expand benefits options in light of the rule. She added that it's an employer's responsibility to notify payroll providers of any changes to exemptions.
Employers also will need to check state laws and consult with counsel ahead of implementing changes to employees' regular rates, as those laws may differ from DOL's new rule, Harthill said. Moreover, "[t]his is an interpretive rule and it remains to be seen whether courts will defer to DOL's interpretation of the rule or if any resultant exclusions are challenged," she added.

The talent textbook: 4 ideas for giving better feedback
Managers enjoy giving good news during a review, but how can reviewers take the sting out of negative feedback or even constructive criticism? Read this blog post from HR Drive for four ideas on giving better feedback.
"You got a promotion! You get a raise!" It's almost as fun for managers to say it as it is for employees to hear. Giving good news during a review is easy, but how can reviewers take the sting out of constructive — or negative — feedback?
Coaching an employee who needs to improve or who isn't quite ready for more responsibility, higher pay or leadership opportunities is perhaps the most difficult aspect of performance management, so in this installment of the Talent Textbook, we'll offer four guiding principles from experts for giving better feedback.
#1: Meet more often
Many talent experts today recommend retiring the annual performance review and replacing it with frequent feedback instead. Unlike annual reviews, continuous feedback sessions can lessen anxiety for managers and workers both, making the conversations less formal and more focused. They can help send the message that the company culture is one of listening and responding to workers' needs — and they help talent pros and managers minimize the risk that workers will be dissatisfied with or surprised by the discussion.
"That feedback should be coming constantly," said Jim Flynn, CHRO at Sitel Group. "Everyone should know where they stand constantly."
Flynn believes that frequency transforms the feedback session into a chance to reflect and recalibrate on priorities and goals. It can also ensure that workers are aware of their progress toward a pay increase, promotion or increased responsibility because their manager has reminded them more recently.
For Jodi Chavez, group president professional staffing group at Randstad Professionals, Randstad Life Sciences, focusing up frequently keeps managers better informed about workers' desires and expectations, potentially preventing turnover and keeping the feedback session from devolving into a bidding war.
"If an employee has a desire and a belief that they want this promotion or to be in that role, there can be instances where you won't be able to undo their desire to leave," she said.
"It can be easier if you catch that earlier on in the process — so constant communication, so they know what you're looking for and you can keep coaching them, is important. It only becomes an issue when no one knows that it's a desire until later in the process."
Just as you wouldn't assess business goals and objectives only once a year, talent pros should expect to assess people often to curb employee disappointment, Flynn said, and this is especially true for employees early on in their careers.
#2: Give a heads up and an open ear
There's still stress for talent pros and managers even when preparing to deliver feedback in a more casual session: Will they feel insulted? Will they disengage afterwards? The fears are relevant, so that's why the way reviewers deliver feedback matters as much as the frequency.
Chavez and Flynn agree that managers and talent pros should begin conversations with what they're going to cover in the session. They can continue to be transparent with workers by providing the reasoning behind the feedback and their expectations for the future, Flynn said.
"I think the old sandwich approach, employees see through that," Flynn said, referring to the tactic of "sandwiching" a criticism between two compliments. "I would rather be more upfront and honest, and that should be the manager's approach to everything."
In that same realm, honest feedback should never come with bias or malice attached. Jeannie Donovan, VP of HR at Velocity Global, wrote in an email to HR Dive that "clear is kind" when it comes to constructive feedback. Whether the manager is discussing goal setting or areas that need improvement, the employee's pay grade or their potential for a future promotion, Chavez said the same principle applies: stick to the facts and strive for objectivity.
"For new talent managers, I think it's important to stay very factual and to hear the employee," she said. "Don't lead with false promises, just very cut and dried — 'The role that you're in and the experience that you have puts you at this level [of pay.]'"
That's not to say that a manager should shut down further discussion, Chavez said. Discussing an employee's strengths and listening to their desires can help them visualize a realistic and reachable future for themselves within the organization.
"It's really important to sit down and talk about the positive things that the employee brings to the table — it's a non-defensive position to put the employee in," Chavez said. "Try to understand what is important to them, and let them tell you. 'I may not be able to be a supervisor, but I'd still like to learn more about how to manage people' — once you know that as a manager, giving them pieces that help fulfill that helps them stay engaged."
#3: Support your managers
Talent pros should focus on workers when they consider their feedback best practices — but managers need their attention and expertise, too. As Flynn put it, "sometimes you have to carry cold water warmly" when delivering feedback, and managers need encouragement, support and guidance from talent pros to pull it off.
"A good HR business partner should understand when those difficult conversations could be occurring," he said, noting that this partnership goes both ways. "If a manager is aware that it might be a tough conversation, it's always a good idea to give your HR business partner a heads up so they can be attuned."
Providing tools or suggestions for approaching reviews can help managers to execute conversations with employees with clarity and mutual understanding. For example, Donovan coaches her managers on the "stoplight exercise," which can be helpful when an employee is making a case for a promotion. She said that managers can take a pen to the job description for the role their charge would like to be promoted into — highlighting current responsibilities in green, responsibilities they have a slight grasp of in yellow and tasks they've never touched in red.
"This is a straightforward way to identify strengths, weaknesses, and gaps to assess readiness for that promotion. Further, if this exercise yields gaps, the results indicate where exactly to focus on growth," she wrote.
Donovan echoed Flynn's belief that managers and talent pros should partner in the feedback process, and that debriefing afterwards is as critical for retention as it is for employee satisfaction.
"Have that second set of eyes to be aware and look for signs of disengagement or other harmful behavior," said Flynn. "Some managers are hands off, so if they've had that difficult conversation make sure you're maintaining that personal connection and increasing your frequency of touch."
#4. Shift the focus forward
The last thing constructive feedback should sound like is a lecture. Reviewers should reiterate that the feedback is in service of plan to get that employee a promotion, salary bump, conference excursion, a chance to lead an internal workshop or whatever the goal is in the future, Chavez said.
"They should feel positive about what they have contributed and what they can continue to contribute," she said. "[It's about] what you can do to help foster that growth for them."
Flynn's approach is similar, keeping the conversation productive and goal-oriented: "I probably spend 25% of the time talking about past performance, and goals reached and past behavior, but I like to focus more on what are the strengths, what are weaknesses and where the potential is."
With the future in mind, Chavez points out that a transparent, frequent and collaborative review process could prevent promising talent from leaving down the road. It can even have ripple effects across an organization, according to Donovan, who saw that workers had a clearer vision of their goals when she transitioned to more continuous feedback.
"As a result of our laser-focus on more frequent performance conversations, our employees have a roadmap of what needs to be done and when, and this approach lends itself to higher productivity and a general sense of purpose across the board," Donovan wrote.

Between the First Step Act bill being passed and SHRM's efforts towards Getting talent back to work, there are a lot of discussions opening up around second chance hiring. Before, it was pretty standard to assume that if you checked that box of "have you been convicted of a felony," you weren't going to get the job.
Today, our unemployment rate is the lowest it's ever been - forcing companies to explore untapped talent pools and unlikely candidates. As the Founder of a staffing agency for second chances, this makes me very excited. But it also frightens me.
I have worked with inmates, felons, and people in recovery over the past five years by helping them find their passion and meaningful employment. It is not as simple as making a decision to hire people with a criminal background. With this being such a hot topic, I thought I'd give a few tips for those considering hiring people with a criminal background.
1. Non-violent drug charges aren't always the safest bet.
I hear it all the time. And usually people who have never been arrested or spent time in prison. They talk about just hiring people who have non-violent drug charges. In my personal experience, those are usually some of my more difficult cases. A lot of people with non-violent drug charges have one of two addictions: 1. making fast money OR 2. doing drugs. Relapse for either of these are more likely if an individual isn't seeking proper treatment or counseling. A job opportunity alone isn't always enough to keep someone on the right path. I have noticed that my best employees are the most unlikely and most overlooked: Those who lost the most. AKA: People who spent time in prison for harsher charges such as assault, robbery or murder.
2. People who spent time in prison are great manipulators.
Manipulation is a skill best learned in prison. Inmates are very resourceful and know how to get what they want. This is why the formerly incarcerated individuals who are reformed make amazing sales people, debt collectors or call center representatives. But we won't always have a reformed person with a change of heart sitting across from us as we are interviewing for a position. Even your greatest "people-reading" employee can be tricked into making the wrong hire if they are not educated on what to look for and what to ask in the interviewing process. Making the right second chance hire can grow your business tremendously but only if you make strategic hires and give the right second chances to the right people. Not everyone wants to change and we have to accept that as a possibility for responsible hiring.
3. Second chance hiring isn't charity.
When people talk about giving a second chance, it always sounds very charity or philanthropy-like. While I'm glad these discussions are happening, I'm disappointed people speak about second chance hiring like it's a favor to someone. It's actually a favor to your company to bring in a hungry, hard-working, loyal employee that will be grateful you gave them a chance. Growing a team of second chance employees can literally grow your business faster. Your second chance hires will go the extra mile, stay late and come in early. Not for a raise or recognition, but to help grow the company that helped grow them. An organic tea company came to us to make their first official second chance hire a year ago. Today, they've hired 70 people who have a criminal background.
When I first started my company, a for-profit staffing agency for second chances, people thought I was crazy. (I am, proudly) But it seemed like a far-fetched goal to bank on the success of felons. I knew how effective second chance hiring would be, so instead of starting a non-profit and spending my time raising money, I wanted to raise men and women through meaningful job placements. I have seen first-hand the successes and failures when it comes to helping people coming out of prison find employment. My biggest fear is that we are going to successfully create an awareness for second chance hiring and see poor results because of lack of education or tools. This could hurt the reputation of what we are trying to do and hurt the reputation of people who really do deserve real opportunities and have transformed their lives.

Chief among the issues that keep employers up at night is staying compliant with federal and state employment laws.
Arguably, wage and hour rules are the most complex and cause the most issues for companies. Job classifications under the FLSA can confuse even the most experienced HR managers.
In fact, some of the costliest wage and hour lawsuits and penalties on record could have been avoided if only the employer properly classified an employee as either exempt or nonexempt. It’s critically important to understand the law — and the devil is in the details.
Exempt or nonexempt?
Most employers understand that an exempt employee is not entitled to receive overtime pay for hours worked in excess of forty hours per week, according to the provisions of the FLSA. Conversely, nonexempt employees are required to receive overtime pay and should be classified as nonexempt from these same overtime provisions.
While it may sound straightforward, figuring out an employee’s exempt status is not that simple. Different types of exemptions exist and each has its own unique set of requirements that are outlined in the FLSA. Most of these exemptions are specific to certain jobs or industries, for example, some exemptions only apply to specific types of agricultural workers, or to truck drivers who transport goods in interstate commerce. But for most businesses, exempt employees will usually fall into one of the following three exemption categories: executive, administrative and professional. Collectively, these are referred to as the white collar exemptions.
A common error that employers make is to classify all their salaried employees, or all employees with the word manager in their title, as exempt. Neither of these factors alone is enough to make the exempt designation. Each of the white-collar exemptions has two components: a salary requirement and a duties requirement. The salary requirement is the same for each of the three exemptions, but the duties requirements are different.
The salary basis test
For any employee to be considered exempt under any of the white-collar exemptions, they must be paid on a salary basis. This means that any employee who is paid by the hour, per day, or is commission-only, regardless of their title or position, will not meet the criteria for any of the white-collar exemptions. How the salary is paid as well as the amount are also subject to certain restrictions. The salary basis test determines the minimum amount, which is subject to change from time to time. The minimum salary is currently $455.00 per week (or $23,660 per year). This test also provides restrictions on when and how an employer can make deductions from an exempt employee’s salary.
An increase to the minimum salary per week from $455 to $913 (or $47,476 per year) was originally scheduled to go into effect back in December 2016, but industry groups against the measure successfully lobbied to block it. The U.S. Department of Labor is exploring alternatives that could appease these industry groups while keeping the regulations in line with the times. The DOL is scheduled to re-start the rulemaking process in March 2019, and prior statements of the current DOL Secretary, Alexander Acosta, suggest that the new rule may propose a more modest salary increase to around $634 per week (or around $33,000 per year).
Job duties
In addition to the salary, each white-collar exemption has its own unique set of duties requirements. Employers must look at the actual duties that each employee performs to determine whether they meet the criteria and their title or position does little to influence the outcome. So, simply naming an employee a manager does not automatically qualify the worker as an exempt employee. To be considered exempt under the executive exemption, which is the most common exemption for managers, this employee would need to supervise two or more full-time employees (or the equivalent) and have the authority to hire and fire employees. Otherwise, they would need to meet the requirements for one of the other exemptions to be paid in this manner.
Knowing that these regulations exist and being well-informed of the framework is the first step in understanding overtime obligations – and reducing wage and hour worries. Employers should seek a qualified employment law attorney for additional guidance on the specifics of each requirement to ensure compliance with applicable overtime laws.

Did you know some insurance carriers pay companies to implement wellness programs? It’s called wellness dollars, and it is insurance companies’ best-kept secret.
Wellness dollars are a percentage of a company’s premiums that can be used to cover wellness-related purchases. The healthier employees are, the fewer dollars insurance carriers need to pay out for a policy. Many insurers have incentives like wellness dollars for employers to improve the well-being of their workers.
The benefits of adding a wellness program are plenty. These programs typically generate a positive return on investment for companies. Research done by three Harvard professors found that overall medical costs decline $3.27 for every dollar spent on wellness programs. Costs from absenteeism fall about $2.73 for each dollar. Well-designed programs can improve employees’ overall wellbeing and life satisfaction, according to a report from the U.S. Chamber of Commerce.
It’s a new year, and group health insurance plans are starting fresh. Here’s how employers can take advantage of wellness dollars.
Get in touch with your carrier. The first step is to get in touch with your insurance carrier to find out if your self-insured or fully-insured plan covers participatory or health-contingent programs. If you don’t have wellness dollars, it’s still early in the year, and it’s worth negotiating to see if you can include them in your company’s current package.
You will work with your insurance carrier to determine how your wellness dollars can be spent, based on an agreed-upon contract. The amount of wellness dollars that you receive depends on the number of employees and profitability.
Every company is different, so the range of services varies and could include wellness programs, gym memberships, nutrition programs, massages and more. Sometimes incentives for wellness activities can be used; sometimes it can’t. Ask your carrier for a complete list of covered expenses. This will help you as you shop around to find the right offerings. Save receipts and records for reimbursements.
Determine the best use. There are a few ways to determine what offerings you should use for your company. Before making any decisions, ask your employees and the leadership team what type of program they would be most likely to engage in. Gallup named the five elements that affect business outcomes: purpose, social, community, physical and financial. Look for a comprehensive program that includes these five elements, instead of coordinating with multiple vendors. If only a portion of your expenses will be reimbursed, it’s still worth getting a wellness program. They have cost-savings on an individual and team level.
Wellness programs are all about building culture, and with unemployment at a record low, it’s a sticking point to keep employees invested in your company. A few examples of wellness offerings include fitness classes, preventive screenings, on-site yoga, financial wellness workshops, healthy living educational workshops, and health tracking apps.
Once you’ve implemented wellness offerings in your workplace, keep track of your company’s progress. Create a wellness task force, a healthy workplace social group, or conduct monthly survey check-ins to make sure employees are staying engaged. Some wellness programs utilize technology to track participation, integrate with wearables, and report other analytics. Ask your insurance carrier if wellness dollars have flexibility in adding or changing the services throughout the year, based on engagement.

The exit interview is a long-time staple of HR departments. But an increasing number of companies large and small are ending the practice of asking departing workers to sit down for a final interview.
The concept seems sound. You can take the opportunity to hear unvarnished opinions about what your company or team does well and what it needs to improve on, and then take that back to management and implement changes that’ll help attract and retain great talent.
In practice, however, the process is often uncomfortable and many HR pros report that the folks who are interested in talking are often the ones who complained the most while on the payroll. The litany of gripes and rehashed personality clashes rarely adds much to the organization’s insight into building a better workplace.
If you can’t say anything nice…
Most of the rest, if they even will agree to an exit interview – and you can’t make them do that, of course – are going to be very careful to say only positive or neutral things about their experience at your organization. That helps to prevent bridge burning for them, in case they ever want to come back or they run into a colleague at a job interview later in their career. But for your team, the result is likely the same as with the complainer in the first example: A one-sided, probably inaccurate picture of what you are doing right and how you can improve in areas that need work.
Finally, much of the work your HR team does to schedule an interview as workers are packing up their personal stuff is likely to be wasted. Advice on employee-focused employment websites and other social media leans heavily towards “How to Avoid the Exit Interview.” Suggested tactics range from saying you can’t spare the time because you don’t want to leave your soon-to-be-ex colleagues hanging to asking to schedule after the leave date and then just ghosting the phone call altogether.
It’s still worthwhile to do a formal review to close out individual projects and to debrief contractors as they wrap up, but it’s probably time to say goodbye to the “tell us what you really think” sessions with employees who have decided to move on.

E-Verify Is Down. What Do Employers Do Now?

What are employers supposed to do now that E-Verify—the federal government's electronic employment verification system—has expired?
Funding and congressional authorization for the program ran out Dec. 22, 2018, as the government went into a partial shutdown after Congress and the White House could not agree on how to fund some agencies, including the U.S. Department of Homeland Security (DHS), which administers the system, for fiscal year 2019.
E-Verify compares information from an employee's Form I-9 to DHS and Social Security Administration (SSA) records to confirm employment eligibility. Employers enrolled in the program are required to use the system to run checks on new workers within three days of hiring them.
During the government shutdown, employers will not be able to enroll in E-Verify, initiate queries, access cases or resolve tentative non-confirmations (TNCs) with affected workers.
All employers remain subject to Form I-9 obligations, however. "Remember that the government shutdown has nothing to do with an employer's responsibilities to complete the Form I-9 [in a timely manner]," said Dawn Lurie, senior counsel in the Washington, D.C., office of Seyfarth Shaw. "Specifically, employees are required to complete Section 1 of the I-9 on or before the first day of employment, and employers must complete Section 2 of the I-9 no later than the third business day after an employee begins work for pay."
No Cause for Alarm
Lurie advised employers not to panic while E-Verify is down. "Employers will not be penalized as a result of the E-Verify operations shutdown," she said. "Employers will not be penalized for any delays in creating E-Verify cases. However, employers are reminded that they must continue to complete I-9s in compliance with the law, and when E-Verify becomes available, create cases in the system."
To minimize the burden on both employers and employees, DHS announced that:
- The three-day rule for creating E-Verify cases is suspended for cases affected by the unavailability of the service. "Normally, the employer enters information from the I-9 into E-Verify within three days of hire, but that won't be possible while the system is unavailable," said Montserrat Miller, a partner in the Atlanta office of Arnall Golden Gregory. "DHS will provide a window of time to submit those held cases once service resumes."
- The time period during which employees may resolve TNCs will be extended. The number of days E-Verify is unavailable will not count toward the days the employee has to begin the process of resolving a TNC. "Employers can't take any adverse action against a worker with a pending TNC regardless, shutdown or not," Miller said. Currently, an employee who chooses to contest a TNC must visit an SSA field office or call DHS within eight federal government working days to begin resolving it. This period will have to be extended because of the shutdown, she added.
- Additional guidance regarding the three-day rule and time period to resolve TNC deadlines will be provided once operations resume.
Amy Peck, an immigration attorney with Jackson Lewis in Omaha, Neb., advised employers to keep track of all new hires with completed I-9s for whom there are no E-Verify queries due to the shutdown. She also recommended attaching a memo in a master E-Verify file tracking the days that the program was unavailable. "I've seen the discrepancy come up years later during an audit," she said.
"Once the system is back up, work with counsel on how much time employees have to resolve their TNCs," Peck said. "Someone receiving a TNC the day before the shutdown is a different case than somebody who had 10 days to resolve their TNC when the shutdown occurred. Those circumstances should be considered on a case-by-case basis."
Federal contractors with a federal acquisition regulation E-Verify clause should contact their government contracting officers to extend deadlines. "Federal contractors have a particular concern because nobody is supposed to be working who has not been verified through the system," Peck said. "People can be hired, but whether they are allowed to work on the contract before being run through E-Verify is a critical consideration that should be discussed with counsel."
Prepare for the Resumption of Service
Miller said employers should monitor the shutdown. "When it is over, log in to the system and see what instructions there are for creating and submitting queries," she advised. "There is an obligation to create those queries if you are enrolled in the program, even if enrolled voluntarily."
The backlog created as a result of the shutdown might have a significant impact on employers that process many E-Verify cases and specifically on the HR staff and other team members in charge of the process.
"Not all employers will be able to push all their cases through at once when the shutdown ends," Miller said. "If everyone did that, the system would crash. DHS will provide instructions on how to submit queries. Employers will be asked why the query is being submitted after the required three days. In the past, 'Government Shutdown' was one of the options in the drop-down menu."
Peck reminded employers that the loss of E-Verify does not mean there is a prohibition against hiring. "Companies should continue to hire as they need," she said.

U.S. Unemployment Drops to Lowest Rate in 50 Years
Last month the U.S. unemployment rate fell to 3.7 percent, the lowest it’s been in 50 years. Continue reading to learn how the low jobless rate is affecting the U.S. labor market.
Unemployment in the U.S. fell to 3.7 percent in September—the lowest since 1969, according to the Bureau of Labor Statistics (BLS).
The low jobless rate, down from 3.9 percent in August, is further evidence of a strong economy—employers added 134,000 new jobs in September, extending the longest continuous jobs expansion on record at 96 months. The continued gains run counter to economists' expectations for a significant slowdown in hiring as the labor market tightens. Through the first nine months of the year, employers added an average of 211,000 workers to payrolls each month, well outpacing 2017's average monthly growth of 182,000.
"This morning's jobs report marked a new milestone for the U.S. economy," said Andrew Chamberlain, chief economist at Glassdoor. "With good news in most economic indicators today, it's likely the economy will continue its march forward through the remainder of 2018."
Cathy Barrera, chief economist at online employment marketplace ZipRecruiter, pointed out that the jobless rate ticked down for all education levels. "Anecdotal evidence has suggested that employers have experienced labor shortages for entry-level positions, and the decline in unemployment for these groups reflects that," she said. "More of those joining or rejoining the labor force are moving directly into jobs, reflecting the high demand for workers."
The sectors showing the strongest jobs gains in September include:
- Professional and business services (54,000 new jobs).
- Healthcare (26,000).
- Transportation and warehousing (24,000).
- Construction (23,000).
- Manufacturing (18,000).
"Retail job losses—20,000 jobs—were widespread, and the leisure and hospitality sector lost 17,000 jobs, largely confined to restaurants," said Josh Wright, chief economist for recruitment software firm iCIMS, based in Holmdel, N.J.
"We can clearly point to a slowdown in retail trade for the dip in [overall] payroll numbers in September," said Martha Gimbel, research director for Indeed's Hiring Lab, the labor market research arm of the global job search engine. "Retail trade had a strong first half of the year but has slowed down in recent months. In addition, recent Hiring Lab research saw a slight dip in the number of holiday retail postings, suggesting that the sector may struggle in months to come."
Prior to September, employment in leisure and hospitality had been on a modest upward trend and the losses last month may reflect the impact of Hurricane Florence.
The Department of Labor said it's possible that employment in some industries was affected by Hurricane Florence which struck the Carolinas in September. Nearly 300,000 workers nationwide told the BLS that bad weather kept them away from their jobs last month.
"That's far below the level in September 2017 amid hurricanes Harvey and Irma, but significantly above the average of about 200,000 over the prior 13 years," Wright said. Upward revisions are likely, he added.
Wages Stubborn but Rising
In September, average hourly earnings for private-sector workers rose 8 cents to $27.24. Over the year, average hourly earnings have increased by 73 cents, or 2.8 percent.
"That's down slightly from the 2.9 percent pace last month, but consistent with a steady upward trend in wage growth we've seen as the job market tightens and more employers face labor shortages," Chamberlain said. "We expect to see that pace continue to rise throughout the holiday season, likely topping 3 percent within the next six months."
Glassdoor has recorded strong wage growth in tech-heavy metropolitan areas such as San Francisco, New York and Los Angeles.
"If the true wage growth rate is at or below 2.8 percent year-over-year, it is disappointing that it is not growing faster," Barrera said. "Given how tight the labor market has been not only with overall unemployment below 4 percent, but particularly so at the entry level, we would expect wage growth to be higher. The labor turnover numbers suggest that mobility is lower than it historically has been in periods where unemployment is very low. This is one reason wages may not be rising as quickly as we'd expect."
Labor Force Participation Stalled?
The nation's labor force participation rate held at 62.7 percent.
"Looking at the labor flows data, the rate of movement of the civilian population into the labor force hasn't moved much in the last couple of years, however, more of those folks are moving directly into employment rather than into unemployment," Barrera said.
Wright noted that the number of new labor force entrants and reentrants going directly to unemployment was just 33,000. "This raises interesting questions—whenever we get a recession, how long will these reentrants and new entrants continue searching for jobs before leaving the labor force?" he asked.
The percentage of the population in their prime working years with a job also held around 79 percent, where it's been for about eight months, Gimbel said, adding that the measure suggests that the number of workers remaining to pull into the labor force may be exhausted.
"The share of the labor force working part-time but who wants a full-time job unfortunately ticked up," she said. "Any remaining slack in the economy may be concentrated in part-time workers who want more hours."

6 Books on the Future of Work That Every HR Professional Should Read
What do the next 50 or 100 years have in store for organizations and workers? Read this blog post for six books on the future of work that every HR professional should read.
As HR professionals and organizational leaders, it seems we are increasingly bombarded with messages about disruptive innovations and the changing nature of work. While calls to prepare strategically for the "future of work" might sometimes seem over-the-top, it doesn't change the fact that we've seen tremendous shifts in the global economy (including the labor economy) and technological innovation over the past 50 years that have had significant implications for the nature of work.
So what do the next 50 years have in store for organizations and workers? How will disruptive technologies like robotics, artificial intelligence/machine learning, pharmacogenetics, quantum entanglement, virtual presence/augmented reality, 3-D printing, and blockchain (among many others) influence future labor markets?
Here are six books I believe every HR professional and organizational leader should read to better understand these trends and the drivers influencing the shifting trajectories in the future of work.
1. The Future of the Professions: How Technology Will Transform the Work of Human Experts(Oxford University Press, 2017) by Richard Susskind and Daniel Susskind
The Future of the Professions closely examines the intersection of rapidly advancing innovative technologies and the shifting nature and transformation of work and the professions, providing theoretically grounding and ample examples of emerging technologies, organizations and work arrangements. It is intended for organizational leaders and policy practitioners of all stripes who are interested in the effects of disruptive technologies on the future of work.
2. The Future of Work: Robots, AI, and Automation (Brookings Institution Press, 2018) by Darrell M. West
In The Future of Work, West sees the U.S. and the world at a "major inflection point" where we have to grapple with the likely impact of an increasingly automated and technologically advanced society on work, education and public policy. The insights provided will be useful to those who manage others and to those who are managed in the workplace of the future.
3. Rise of the Robots: Technology and the Threat of a Jobless Future (Basic Books, 2016) by Martin Ford
Rise of the Robots is a somewhat unsettling vision of a future world dominated by artificial intelligence, machine learning and highly automated industries, where most members of the current workforce find themselves replaced by technology and machines; in other words, a jobless future. Based on recent economic and innovation trends, Ford argues that the rapid technological advancement will ultimately result in a fundamental restructuring of corporations, governments and even entire societies as middle-class jobs gradually disappear, economic mobility evaporates and wealth is increasingly concentrated among the elite super-rich.
4. Gigged: The End of the Job and the Future of Work (St. Martin's Press, 2018) by Sarah Kessler
Gigged examines the shifting psychological contract between organizations and workers, discusses trends in the organization of work, and documents the movement in recent decades away from traditional employment models and toward part-time work and contingent employment arrangements such as independent contracting and project-based "gig" work. While such work has always been a part of informal economies around the world, the trend is increasingly common in traditional organizations as well, bolstered by the success of companies like Uber and Airbnb.
5. The Future of Work: Attract New Talent, Build Better Leaders, and Create a Competitive Organization (Wiley, 2014) by Jacob Morgan
In The Future of Work, Morgan continues the argument that the world is changing at an accelerated pace. He demonstrates that the way we work today is fundamentally different from how previous generations worked (due to globalization, technological innovation and shifts in the composition of national economies) and suggests that the future of work will be drastically different from what we experience today (a shift from knowledge workers to learning workers), where employees can work anytime and anywhere and can use any devices.
6. Shaping the Future of Work: A Handbook for Action and a New Social Contract (MITxPress, 2017) by Thomas A. Kochan
Probably the most academic book on this list, Shaping the Future of Work acknowledges an increasingly digitized economy and examines the resulting shift in social contract with regard to work and the professions. Kochan provides a road map for what leaders across contexts need to do to create high-quality jobs and develop strong and successful businesses.
What Does All This Mean?
In the next 50 years, we will likely see:

So what does this all mean for HR professionals and organizational leaders? What are the core competencies of organizations that are prepared for these technological disruptions? How does the shifting nature of work influence needed HR competencies?
Regardless of what the future holds, these are questions we need to be asking and discussions we need to be having so that we are prepared for the future of work.
